ChatGPT and Data Privacy
In Switzerland, the use of ChatGPT is permitted. However, the Federal Data Protection and Information Commissioner, or FDPIC, advises users to adopt a conscious approach to AI technologies. According to the FDPIC, the benefits for society and the economy must outweigh the risks to user privacy.
Especially concerning personal data, we advise against sharing it with such AI. This is because the data could potentially be disclosed to another user.
Companies that use AI-based applications are obligated to comply with data protection requirements. This primarily means providing transparent and understandable information: What data is processed, for what purposes, and in what manner?
Italy temporarily banned ChatGPT on March 30, 2023. This prohibition was one of the reasons for its delayed introduction in Switzerland. The FDPIC is consulting with the Italian data protection authority to provide an assessment of Swiss data protection compliance. The Italian authority cites the following reasons for the ban:
👉 Violation of the duty to inform.
👉 Lack of lawfulness in data processing.
👉 Lack of data accuracy.
👉 Missing age verification.
All reasons refer to the EU General Data Protection Regulation (GDPR). The Swiss Data Protection Act is not a copy of the GDPR, which means these points cannot be directly applied to Switzerland. Furthermore, some of the accusations made by the Italian data protection authority would also apply to most search engines, such as Google.
